Three things to know right now.

01.Kentucky has a state inheritance tax — but Class A heirs (immediate family) are exempt.

Kentucky is one of only a handful of states with a state inheritance tax. The rate depends on the heir's relationship to the decedent: Class A (spouse, parents, children, grandchildren, siblings) pay nothing. Class B (nieces, nephews, daughters/sons-in-law, aunts, uncles) pay 4-16%. Class C (everyone else, including charities other than qualified ones) pay 6-16%. For most KY families leaving assets to immediate family, the tax is zero.

02.Kentucky has a filial-responsibility statute — but enforcement is rare.

KRS 530.050 includes a filial-support provision that, on paper, could make adult children liable for indigent parents' nursing-home bills. Unlike Pennsylvania (which actively enforces under the Pittas precedent), Kentucky has essentially no body of caselaw using the statute against adult children. Still — clean Medicaid paperwork and timely application are the practical defense.

03.Kentucky Medicaid runs through managed care — and the 5-year look-back applies.

Kentucky Medicaid (administered by the Department for Medicaid Services within the Cabinet for Health and Family Services) uses managed-care organizations for most beneficiaries. The federal 5-year look-back and standard asset/income tests apply. HCBS waivers cover home-based care for eligible seniors.
