Missouri

Caregiving in Missouri.

No state estate or inheritance tax, a robust MO HealthNet (Medicaid) long-term-care program, a distinctively detailed Power of Attorney statute (RSMo §404.700 et seq.), and a Beneficiary Deed law that lets real estate skip probate. Missouri caregiving leans on a well-organized state framework with no major surprises.

Three things to know right now.

01.No state estate tax, no state inheritance tax.

Missouri imposes neither a state estate tax nor an inheritance tax. The state never re-enacted an estate tax after the federal pickup credit was eliminated. For most Missouri families, the only estate-tax exposure is the federal estate tax (~$13.99M exemption per individual in 2025) — meaning the vast majority of estates face no estate tax at all.

02.Missouri has a detailed POA statute — and a Beneficiary Deed worth using.

Missouri's Durable Power of Attorney Law (RSMo §404.700 et seq.) is one of the more carefully drafted POA statutes in the country, with explicit provisions for gift authority, healthcare proxy interaction, and accountings. Missouri's Beneficiary Deed (RSMo §461.025) lets real estate pass at death without probate when properly recorded during life — used widely.

03.MO HealthNet covers long-term care; the 5-year look-back applies.

Missouri calls its Medicaid program MO HealthNet, administered by the Missouri Department of Social Services. MO HealthNet for the Aged, Blind, and Disabled (MHABD) covers long-term care, with the standard federal 5-year look-back on transfers. Missouri's HCBS waivers — including the Aged and Disabled (AD) Waiver — pay for in-home care for eligible seniors.

How we research Missouri-specific guidance.

Every state page is built from three sources: the state’s own statutes and regulatory filings, federal CMS and SSA documents that apply, and direct input from at least one credentialed reviewer who practices in or is licensed in that state. We re-review every state page quarterly. Missouri was last fully reviewed on May 21, 2026 by Reviewer to be assigned.
