New Mexico

Caregiving in New Mexico.

Community-property state, no state estate or inheritance tax, Medicaid administered through Centennial Care 2.0 managed care, and a distinctive Native American Tribal LTC framework that affects a substantial share of the state's senior population. New Mexico's caregiving landscape sits at an unusual intersection of community-property law, managed-care Medicaid, and tribal sovereignty considerations.

Three things to know right now.

01.New Mexico is a community-property state — both spouses jointly own most marital assets.

Like Arizona, California, and Nevada, NM treats most assets acquired during marriage as community property, regardless of whose name is on title. This affects Medicaid spend-down math, estate planning, and the use of revocable trusts — and tends to surprise families with estate plans drafted in common-law states.

02.Native American Tribal long-term care is a meaningful factor for many NM families.

NM has 23 federally recognized Tribal Nations, and a substantial share of the state's senior population are tribal members. IHS / 638-program facilities, tribal Medicaid coordination, and tribal estate planning each have distinct frameworks that interact with state and federal rules. Families with tribal members need NM-experienced counsel.

03.NM Medicaid LTC runs through Centennial Care 2.0 managed care — Turquoise Care effective 2024.

The NM Human Services Department (HSD, now NM Health Care Authority) administers Medicaid through managed care. Centennial Care 2.0 was renamed Turquoise Care effective July 2024; long-term services are delivered through three MCOs: BCBS NM, Presbyterian Health Plan, and Western Sky Community Care (or current contracted MCOs).

How we research New Mexico-specific guidance.

Every state page is built from three sources: the state’s own statutes and regulatory filings, federal CMS and SSA documents that apply, and direct input from at least one credentialed reviewer who practices in or is licensed in that state. We re-review every state page quarterly. New Mexico was last fully reviewed on May 21, 2026 by Reviewer to be assigned.
